Terms of service

By purchasing a Mystery Day Trips Inc. product through our website, you agree to the following Terms of Service.

Please read carefully before completing your purchase.

Purchases and Sales

  • All purchases made through the Mystery Day Trips’ website are final.
  • Prices are listed in Canadian dollars (CAD) unless otherwise indicated.
  • Once a purchase is confirmed, it cannot be canceled, exchanged or transferred.

Shipping Address Accuracy and Reshipment Policy

  • By completing and submitting an order on our website, you confirm that the shipping address provided is complete and accurate at the time of purchase. Mystery Day Trips is not responsible for orders shipped to incorrect or incomplete addresses entered by the customer. Customers are solely responsible for ensuring all shipping details are accurate prior to finalizing their order.
  • If an order is returned to Mystery Day Trips because the address provided was incorrect or undeliverable, we will reship the order at your request for an additional reshipping fee based on the current rate for the original shipping method, plus applicable HST.
  • If an order shipped to an incorrect or undeliverable address is not returned to Mystery Day Trips and cannot be recovered, the customer is responsible for the loss of the product. The customer may place a new order online at the then-current retail price, plus applicable shipping and taxes.

Refunds and Defects

  • Where an incorrect, incomplete or outdated shipping address was provided by the customer at checkout and the order was processed and shipped in accordance with that address, no refunds will be issued for non-delivery, mis-delivery or loss of the product. By placing an order, you agree that your recourse in these circumstances is limited to the reshipment and replacement options described above.
  • Refunds will only be issued in the event of a defective product (e.g., missing or incomplete materials necessary for your Mystery Day Trip).
  • To request a refund due to defect, you must contact Mystery Day Trips Inc. within thirty (30) days of purchase with proof of the issue.
  • No refunds or credits will be provided for dissatisfaction with the trip experience, weather conditions or other factors beyond our control.

Assumption of Risk/Release of Liability

  • By participating in this Mystery Day Trip (“MDT”), I acknowledge that I am doing so voluntarily and at my own risk. I understand that participation may involve inherent risks, including but not limited to injury or death caused by physical exertion, travel by vehicle or on foot, interaction with public spaces, activities at third-party establishments, consumption of food or beverages, exposure to environmental conditions, accidents or other unforeseen events.
  • I freely and knowingly assume all such risks and accept full responsibility for any personal injury, death, property damage, loss or other harm that I may suffer, however caused, arising from or in connection with my participation in the MDT.
  • I understand and agree that MDT may provide itineraries, recommendations, or directions to third-party businesses, attractions, restaurants, venues or service providers (“Third Parties”), but does not own, operate or control them.
  • I acknowledge that any services, products, or experiences provided by such Third Parties are entirely outside the control of MDT, and that any risks, injuries, damages or disputes arising from such involvement are solely between myself and the Third Party.
  • TO THE MAXIMUM EXTENT PERMITTED BY ONTARIO LAW, I RELEASE, WAIVE AND DISCHARGE MYSTERY DAY TRIPS INC., ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, VOLUNTEERS AND AGENTS, FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION OF ANY KIND, WHETHER KNOWN OR UNKNOWN, WHICH MAY ARISE OUT OF OR RELATE IN ANY WAY TO MY PARTICIPATION IN THE MDT, INCLUDING BUT NOT LIMITED TO MY USE OF OR RELIANCE ON THIRD PARTIES OR THEIR SERVICES.
  • I confirm that I am of the age of majority in Ontario and am legally competent to agree to this release. I have read, fully understood, and voluntarily accept this assumption of risk and release before participating.

Third-Party Experiences

  • Mystery Day Trips Inc. packages may include recommendations or directions to third-party attractions, businesses or services.
  • We do not own, operate or control these third parties and are not liable for their actions, omissions or policies.
  • Customers are encouraged to independently review safety, accessibility and suitability of any third-party venues included in their trip. 

Personal Responsibility

  • Participants are responsible for ensuring they are physically capable of completing suggested routes and activities.
  • Customers are responsible for following applicable laws, regulations and safety guidelines during their trip.
  • Any costs incurred (such as admission fees, parking or food purchases) are the responsibility of the participant unless explicitly stated as included.

Limitation of Liability

  • Mystery Day Trips Inc. and its affiliates shall not be held liable for any direct, indirect, incidental or consequential damages arising from the use of our services.
  • Our liability, if any, is strictly limited to the amount paid for the purchase.

Changes to Terms

  • Mystery Day Trips Inc. may update these Terms of Service at any time. Updates will be posted on our website and will apply to future purchases.

By completing a purchase, you confirm that you have read, understood and agreed to these Terms of Service.
